Tower Hamlets Council’s statement of 3rd December fails to mention that Apasen has brought the situation to Court. It has issued High Court proceedings against the Council, alleging that the Council acted unlawfully in relation to a highly opaque procurement exercise.
Apasen has been advised throughout by solicitors and a King’s Counsel and expects to win its claims.
Despite claiming to address “misinformation” and claims made by Apasen and others outside court, the Council’s statement fails to specify these claims and cannot therefore do as it say it intends. Apasen’s solicitors have requested urgent clarification, which as of 3pm on 5th December remains unprovided. This supports the view that the Council’s statement was made for other reasons, including to harm Apasen through a partial and distorted account, and not to redress misinformation.
The Council’s statement was issued without any notice to Apasen or any attempt to agree on the information that could be put in the public domain relating to the dispute. Apasen has always encouraged cooperation on this matter and is disappointed by the Council’s approach.
Apasen is taking advice on what further information it would be right to bring to public attention in relation to these essential legal proceedings.
